Important Bills passed by Parliament in Budget Session 2015-16

Hello friends , today we are going shareImportant Bill passed by Parliament in Budget Session 2015-16.The budget session of Parliament will begin on February 23, 2015. Government led by the prime minister Narendra Modi will present its first full year budget on February 28. The first part of the session would be from February 23 to March 20 and the second part from April 20 to May 8. The railway budget would be presented on February 26 and economic survey on February 27.

Important Bill passed by Parliament in Budget Session 2015-16:-

Citizenship (Amendment) Bill, 2015:-Parliament passed the Citizenship (Amendment) Bill, 2015. It was passed by Rajya Sabha on 4 March and earlier by Lok Sabha on 2 March 2015. This bill will replace an ordinance promulgated in this regard and amend the Citizenship Act, 1955.

Key provisions of the bill :-
1. The Bill mergers of Person of Indian Origin (PIO) and Overseas Citizenship of India (OCI) schemes.
2. It also provides 30-day break to person who applies for Indian citizenship if they have to leave India for some time.
3. It gives power to Union government to cancel the OCI card obtained by the spouse of an Indian citizen if the marriage is dissolved by a court or the spouse enters into another marriage even while the first marriage has not been dissolved.

Coal Mines (Special Provisions) Bill, 2015:-Lok Sabha on 4 March 2015 passed the Coal Mines (Special Provisions) Bill, 2015. This bill will replace the Coal Mines (Special Provisions) second ordinance, 2014.

Key provisions of this bill:-
1. The bill has provisions for allocation of coal mines through a transparent bidding process i.e e-auction.
2. The e-auction of coal blocks will ensure the continuity in coal mining operations and promoting optimum utilization of coal resources.
3. Bill also facilitate e-auction of coal blocks for private companies for captive use and allot mines directly to state and central Public Sector Undertakings (PSUs).

Insurance Laws (Amendment) Bill, 2015:-Lok Sabha on 4 March 2015 passed the Insurance Laws (Amendment) Bill, 2015. It was passed by voice vote and replaces ordinance promulgated in this regard.

key provisions of this bill:-
1.Hikes Foreign Direct Investment (FDI) cap in the insurance sector to 49 percent from present 26 percent.
2. Establishment of Life Insurance Council and the General Insurance Council. They will act as self-regulating bodies for the insurance sector.
3.Imprisonment of up to 10 years for selling policies without registration with the insurance regulator.
4.Prohibits an insurer from challenging the life insurance policy on any ground after a period of three years of selling it.

Motor Vehicles Amendment Bill, 2015:-The Lok Sabha on 3 March 2015 passed the Motor Vehicles Amendment Bill, 2015 by voice vote. The Bill seeks to amend the Motor Vehicles Act, 1988 and replace the ordinance promulgated in this regard.

Key provisions of this bill:-
1.The Bill defines E-carts and e-rickshaws as special purpose battery powered vehicles with power up to 4000 watts and having 3 wheels. Bill mentions that these vehicles can be used for carrying goods or passengers.
2. It also mentions that these vehicles should be manufactured, equipped and maintained in accordance with specifications as prescribed by Union government.
3. The Bill exempts drivers of e-rickshaw and e-cart from the requirement of learner’s licence to drive.

Mines and Minerals (Development and Regulation) Amendment Bill, 2015 :-Lok Sabha on 3 March 2015 passed Mines and Minerals (Development and Regulation) Amendment Bill, 2015 to replace ordinance promulgated in this regard.

Key provision of this bill:-
1.Lease period- Mining leases will be granted for a lease period of 50 years for all minerals other than coal, lignite and atomic minerals. Lease period for coal and lignite remains unchanged.
2. All mining leases granted for such minerals prior to this bill, will be valid for 50 years. While, in case of expiry of the lease it will be put up for auction instead of being renewed.
3. Mining leases will be granted through auction by competitive bidding process, including e-auction. The Union government will prescribe the terms and conditions, and auction procedure including parameters for the selection of bidders.
4. Transfer of mineral concessions: The Bill states with the approval of the state government, the mining lease holder may transfer the lease to any eligible person and as specified by the Union government.
5. Creation of a District Mineral Foundation (DMF) by the state government for the benefit of persons in districts affected by mining related operations. Creation of a National Mineral Exploration Trust (NMET) by the Union government for regional and detailed mine exploration.

Constitution (Scheduled Castes) Orders Amendment Bill, 2014:-Rajya Sabha has passed the Constitution (Scheduled Castes) Orders Amendment Bill, 2014. It was unanimously passed by a voice vote. The bill seeks to modify the list of Scheduled Castes in three states- Haryana, Karnataka, Odisha and one Union Territory- Dadra and Nagar Haveli.

Amendments:-The Bill amends the Constitution (Scheduled Castes) Order, 1950 and the Constitution (Dadra and Nagar Haveli) Scheduled Castes Order, 1962. The Bill adds the following communities to the list of Scheduled Castes:
Haryana: Kabirpanthi, Julaha.
Karnataka: Bhovi, od, odde, Vaddar, Waddar.
Odisha: Dhoba, Dhobi, Dom, Dombo, Duria Dom, Katia, Kela, Nalua Kela, Khadala and Turi.
Dadra and Nagar Haveli: Chamar.

Background:- The bill was first tabled in 2014 but lapsed after the previous 15th Lok Sabha was dissolved. It was again introduced by the NDA government to end all kinds of atrocities against the Scheduled Castes in these states. The bill was introduced in Parliament as per the provisions of Article 341 of the Constitution.
